Agreement
|
1. User rights
a. Use of the site is partially free, and partially limited to registered users only.
b. Use of limited-access areas for registered users only (limited pages) are only permitted to those given authorization and a password. Users are not allowed to let others access limited-access pages on the site or transfer information from the limited-access pages, for free or for a charge, without written authorization from UniversiTip.
c. The password given upon registration is provide and is not to be shared, unless written authorization is given by UniversiTip.
d. Use of the site is limited to academic purposes and is forbidden to be used for any other commercial purpose, such as creating academic libraries, electronic infobanks, printouts, commercial information services, etc. Likewise, users are not authorized to widely distribute information found on the site.
2.Copyrights
a. Exclusive rights for the site, including its design and graphic elements appearing on it, belong to Smartbiz Inc. Users are reserved the right to use the site for reasonable personal use, according to these conditions and the law, and not for commercial purposes.
b. Anyone who publishes their work of the site in doing so is declaring that he owns exclusive rights to the published work and he is offering it for sale in accordance with the website’s regulations.
3.Links: UniversiTip is not responsible for the content of the sites containing a link back to the UniversiTip site, nor to the quality of services they provide, and it will not carry any responsibility regarding these sites. Links on other sites should not be taken as recommendations to use the other sites and are there for the convenience of the user alone.
4.Email. There is the possibility of sending an email to UniversiTip. Emails sent to UniversiTip are not confidential. They are accessible by all UniversiTip staff and may reach third parties according to necessity.
5.Buyers.
a.The buyer declares that he knows that the papers he is buying from UniversiTip are protected by the copyrights of their authors.
b. The buyer commits to not using the purchased academic material in any way that violates the rules of the academic institution where he studies.
c. The buyer will receive authorization for the use of the academic material, but no the copyrights.
d. The buyer commits not to plagiarize the content of the papers, but to use them as reference materials only.
e. Use of the content of the Term Papers is by responsibility of the buyers along.
f. The buyer commits not to distribute and/or sell and/or transfer the content of the papers to any third party.
g. UniversiTip is not responsible for the content of the papers presented on the site.
h. UniversiTip will not take any responsibility for damage claims and/or expenses to the buyer resulting from buying and using papers from the site.
6. Publishers
a. ownership – the publisher declares that he is owner of exclusive rights to the published material and he is interested in selling it on the UniversiTip site according to the conditions of agreement. UniversiTip will no carry any responsibility for lawsuits regarding copyrights on the work. The sole person responsible is the publisher of the work.
b. License – the publisher hereby grants permission to UniversiTip to present, advertise, edit, market and sell his work on the site. UniversiTip is allowed to add information to published materials (such as a logo or any other identification mark) which testifies that the material was digitally edited and published by UniversiTip.
c. Publication period – Papers will be published on the UniversiTip site for a period of no less than two years from the day of its publication.
d.The publisher is allowed to add additional information describing the published paper, and he thereby commits to the fact that the information is correct and accurate. Any demands or claims regarding the accuracy of the information will be towards the publisher alone.
e.UniversiTip payment – UniversiTip will pay the publisher for each work sold on the site a sum of 40% the price of the work. For every paper sold by a friend in the publisher’s network (up to four levels deep), the publisher will receive compensation equal to 30% of the profit earned by the friend for the sale, to the power of the number of levels away the friend is. To remove any doubt regarding the payment amount received by the publisher for the sale of his friends’ work on the site:
Level 1: 30%
Level 2: 30%*30% = 9%
Level 3: 30%*30%*30% = 2.7%
Level 4: 30%*30%*30%*30% = 0.81%
Payments will be made within 30 days of the end of each quarter for the sum of the sales and/or profits carried out in the previous quarter. If the total sum is equal to less than 50$, UniversiTip will transfer the payment within 30 days of the end of the first quarter in which there is an accumulated profit of over 50$.
Payments. As a rule, revenues from the sale of Term Papers will be transferred to the publisher of the paper with VAT deducted, as by law. If the publisher of the work is a registered business or a company and issues receipts for this income, VAT will be added to the price.
f. Communications conditions. UniversiTip is allowed to stop communications with the publisher with or without a reason. In this case, UniversiTip must remove all works by the publishers from the site, and they will return to his sole ownership. Likewise, UniversiTip will send an email ending the contract to the email address the publisher provided to the site.
g.Relationship between the parties. Nothing written in this contract establishes a partnership between the parties and/or a relationship of employer-employee, representative, agent or emissary.
h. Limited responsibility – UniversiTip is not responsible to the publisher and or any third party for any direct or indirect damage that may be caused as a result of the publication of his work on the site.
i.Publication. UniversiTip is not obligated to published works on the site and can remove works publishes on the site at any time with or without reason.
j. Taxes. The publisher is responsible to report to the tax authorities income earned from the site.
7.Information security
UniversiTip takes the common precautionary steps in order to guard, as much as possible, information privacy. Every transfer of a credit card number from the website is encoded according to common standards. However in a case which is out of UniversiTip’s control and/or comes from a higher power, UniversiTip will not be responsible for any damages of any kind, direct or indirect, that may be caused to you if this information is lost or used without authorization.
